BLOCK CREEK FARM
STALLION BREEDING CONTRACT made and
entered into on this ________day of ________, 20____, is by and between
Block Creek Farm. (hereby further referred to as the farm) and Harriet
McCord (hereby further referred to as stallion owner),
and___________________________________, hereinafter designated Mare
Owner. Mare Owner agrees to breed the Mare_________________, Breed
__________Reg #___________, to the Stallion ___________________________,
for the Stud Fee of
_____________,
for a live foal, subject to the following conditions:
A booking fee of $150.00 and the
$________stud fee must be paid
prior to the mare being bred. The booking fee and stud fee are non-refundable. The
Stallion Owner or Stallion Manager requires 48 hours advance notice when
the Mare Owner wishes to remove his mare(s) from the farm.
Mare care will accrue
from the date of mare’s arrival at the rate of $______ per day.
It is recommended
mares be wormed within 30 days and vaccinated within 60 days of entering the farm.
The State of Texas
requires a current negative Coggins test on all mares.
The Mare Owner shall
agree that each mare offered for breeding shall be in sound breeding
condition and free from infection or disease. An Endometrial swab and
cytology culture will be required before the mare arrives at the farm -
unless otherwise agreed. Any mare certified by the stallion owner
not to be, in her opinion, in sound breeding condition shall not be
bred. A Mare Owner may not substitute another mare within that breeding
season unless specifically approved and entered into in writing by both
mare owner and stallion owner or manager.
The Stallion Owner
and/or manager, agrees to diligently try and settle the above named mare
and shall have sole discretion of determining the best method of
breeding such mare (live cover or AI). If, however, the mare does not
settle, the Stallion Owner and/or manager shall be held harmless. If the
mare fails to settle, the mare may be brought back the following season
or another mare may be substituted with written approval from the
stallion owner. No refunds are given. There will be no guarantee of a
live foal for any mare leaving Block Creek Farm before being checked “in
foal" or checked by mare owners vet within 18 days of last breeding
date.
This is a Live Foal
Guarantee.A live foal is
described as a newborn foal that stands and nurses without assistance.
If the foal will not stand and suck, and death occurs, the Mare Owner
will be entitled to a free breeding during the season of the foaling year only, and to the same Mare unless otherwise agreed to substitute
another mare.. This guarantee does not include death
from injury to the foal. Only the Stud Fee is free, all other fees
apply, and are the responsibility of the Mare Owner. This Guarantee will
apply only if Stallion Owner is notified within 7 days from the time of
death of the foal. This notice must be accompanied by a statement from a
licensed veterinarian. The Mare Owner must pay any board, and/or
veterinary charges if Mare returns for a re-breeding. Mare Owner agrees
that Stallion Owner and/or Manager does not make any guarantees as to
the quality, or conformation of the foal nor that the foal will be free
of any infirmity, conformation defect, disease, or inherited trait.
The breeding season
for this contract shall begin January 1, close July 31
unless other arrangements have been made.
It is further agreed
that should the above named Stallion die, or become unfit for service,
or, if the above named mare dies, during the breeding season then the
Mare Owner may substitute another mare, breed the above named mare to
another stallion on the farm that is agreed to by both the Mare Owner
and Stallion Owner.
A breeder's
certificate will be issued to Mare Owner after ALL expenses have
been paid in full and upon notification of the birth of the foal and
visual or photographic proof of foal with mare is provided to Block
Creek Farm.
Waiver of Liability. It is understood that
Block Creek Farm., and its owners, employees, veterinarians, and guests
shall not be liable for any injury, escape, disability, or death of any
horse on its premises. The above named Mare Owner, whose horse(s) are
under the care of Block Creek Farm., will not be liable or responsible
for any damage, injury, or death to the breeding farm stallions,
employees, veterinarians, or other animals In the care of Block Creek
Farm, whether or not caused by his horse.
This contract is
non-assignable and non-transferable.
ENTIRE AGREEMENT:
This Contract constitutes the entire agreement between
the parties hereto and may not be modified except in writing and signed by all participating parties. This Contract shall not be assigned, sold or transferred
by any parties hereto without the consent of the others. If the original
designated mare is to be replaced by a substitute mare then approval of
substitute mare by Harriet McCord is required and a new contract will be
issued forthwith by both Harriet McCord and the Mare owner.

A. The Stud Fee for
______________________ is $________. The Booking Fee of $150.00 is due
with the signed STALLION SERVICE CONTRACT. Mares should be booked
early. A Copy of the MARE'S REGISTRATION PAPERS (both sides) must also
be included with the signed Contract.
C. The Stud Fee, is
due before mare is bred and the remaining fees (veterinarian, board,
etc.) must be paid in full before the mare leaves the farm. Block Creek
Farm will provide a detailed written list of all the fees that may have
occurred. MARE WILL NOT BE RELEASED UNTIL ALL
FEES AND CHARGES ARE PAID.
D. For your
convenience, we do accept all major credit cards through Paypal.com.
There is a 3% surcharge to use this service.
E. Live Foal
Guarantee: If the Mare does not produce a live foal, a rebreed
will be allowed for the same mare or a substitute mare for the following season only.
F. Mare (and foal, if
applicable) will be periodically vaccinated and wormed as deemed
necessary by our Veterinarian or barn manager at Mare Owner's expense.
Every effort will be made to insure that your mare (and foal) receive
the best care possible. (See appendix 1 below)

Mare Owner is advised Block Creek Farm will not accept
mares for breeding on premises that are not halter-broken and/or cannot
be tied or placed in Breeding Stocks. Mare Owner authorizes Block Creek
Farm and/or, if specifically requested, a licensed Veterinarian to breed
their mare/s and will be responsible for any veterinary expenses deemed
advisable or necessary with regard to breeding the mare, including the
cost of diagnostics such as palpation and/or ultrasound examinations as
well as any emergency treatment due to illness or injury of the mare
and/or her foal. (cost of procedures requiring the services of a
Veterinarian will be billed for the Veterinarian directly to the Mare
Owner.) Purchaser also understands and agrees that the mare be
tranquilized for breeding purposes in the interest of her safety or
Staff’s, if deemed reasonable or necessary by attending personnel. Staff
also requests that foals be halter-broke before arrival so they may be
kept under control during all required breeding diagnostics or
insemination of their dams.
ON SITE MARE/FOAL CARE & LIABILITY RELEASE:
Board for on site dry mares is $_______ per day. A mare
with foal’s board will be $_______ per day. Mares with foals are housed
separately from other on site horses. All due diligence and personal
observation are exercised in taking quality care of on-premise mares
and/or foals. Mare Owner stipulates and agrees, however, to hold Harriet
McCord, Block Creek Farm, its agents and employees harmless from any and
all damages, injuries and/or loss associated with the mare/s and/or
foals. Purchaser authorizes Staff to take immediate appropriate action
in treating and caring for any animals in their care should Purchaser be
unavailable for urgent consultation at the time a dire emergency might
arise. Clients are urged to advise Block Creek Farm of their exact
location and telephone numbers should they plan to be away from a
permanent residence or normal place of business for an extended period
of time while their animals are left in the custodial care of Block
Creek Farm. If applicable, Purchaser agrees to notify. Block Creek Farm
name and emergency telephone number of any new Insurance Company to whom
their equine policy may have been transferred after the execution of
this Breeding Contract.
No mare/s can be accepted on premises who have not
received a Negative Coggins Report within 3 months prior to date
of their arrival. All vaccinations, including West Nile Virus, and
working programs should be current. Mare Owners are also urged to have
their mare’s cultured (if applicable) and/or checked for breeding
soundness prior to arrival. We require that all mares have shoes
removed and feet trimmed prior to arrival at Block Creek Farm. We strongly suggest mares be put under
lights in December of the year prior to their scheduled breeding in
order to avoid unsuccessful "transitional" heat cycles. Any
animals delivered to Block Creek Farm who exhibit illness, nasal
discharge, etc., will not be accepted upon arrival. The goal is to have
client horses arrive healthy and remain healthy while on Block Creek
Farm premises, as well as our own.
The horses in residence at Block Creek Farm are fed
high-quality feed and high-quality Coastal Bermuda hay twice per day. If
Purchaser’s mare/s require a different diet, such as alfalfa rather than
Coastal Bermuda, please discuss this preferences with Harriet McCord and
make the necessary arrangements prior to delivery of the mare/s. Due to
the diet sensitivities of some horse, it is suggested that Mare Owners
bring a 3-day supply of their animal’s usual diet in order to make any
transition in feed or feeding schedules less stressful. If the mare/s
and/or foal/s are known to have any allergies to drugs, topical sprays,
etc., please advise Block Creek Farm of that information upon
delivery of the animals.
